I was going to have my brother down load but after I saw Duff's request, I dropped my brother a email to tell him to disregard. I repect his wishes. I understand why people download and all that. I just hope that some day this gets released and I will be the first in line to buy it where I live at.

Well, the thing is that this is copyrighted material.

It's not a bootleg from a gig.

It's like posting the whole Contraband record on mp3's for people to download.

The difference is that you can walk into a store and buy contraband, you can't walk into a store and buy BD

I'm sorry, but I'll have to disagree with you there. Contraband is an officially released album that most people in the world can go out and buy. Beautiful Disease is sitting on a shelf collecting dust somewhere at Geffen/Interscope/God knows where...and is mostly likely never going to see the light of day.

If I thought for a second that I was somehow depriving Duff of money that's rightfully his by offering this album, I would NEVER do it. Duff doesn't own the rights to BD, which is why he re-recorded a lot of the songs on the Loaded Dark Days album.

I offered BD on my site because I was tired of seeing the insane prices of copies of it on Ebay. Frequently they were reaching over $50 for a COPY, and there aren't a lot of people that could afford that. My copy was given to me, and I've given it to a lot of people since then.

If someone contacts me from Duff's camp, or even the record label that owns it, and asks me to remove it then it'll be gone. I can only afford to have it up for another month or so anyway, so I seriously doubt anyone's going to come knocking.

And like everyone else here....if it ever becomes available commercially, I'll be the first one in line to buy it! I want it officially released! It's far too good to not be heard.

I stand by my previous post. It's copyrighted material.

The fact that some assholes sell it on Ebay for 50$ doesn't make what you do right...

If Duff wanted it released he would have made a site himself and put it online, I'm pretty sure he can afford the bandwidth... But as you see from his message here, he's not too much into this...

Now that would be a good idea.

But I suspect that as Mistress said its Geffen (or whatever their called now) who own the rights and get to decide how and where the album is released.

I just hope it becomes avalible one day.

You are right and if he was under contract to produce a specific number of albums before the merger and he fulfilled his contract then there's the contractual questions of the issuing of the CD, while i am sure that Duff owns the copyrights to all of the songs (as i think some of them were released on Dark Days) you can't know what the contract language is about the actual CD.....and obviously i don't know what the terms of the contract are/were so I cannot say for sure who would have the right to release the CD, not the songs.....that's about all i remember from my copyright class kids!

It was just the songs that were being given away. (I don't have the time, money, equipment, skills or inclination to be making actual CD's and sending them to people.)

Your right that Duff must have the rights to have used them on Dark Days though. (And I find it hard to believe that he would have released the rights to his songs to someone else anyway.)

Ultimatly the fact that Duff asked for the site to be taken down is all I need.  But I would love to know who made the descision and why.

LOL I thought the hand written note from Duff was cool. It seems like this is turning into a downloading issue so allow me to put my two cents in. I download music to find out if I enjoy the artist or not 'cause I can't stand the listening boots at record stores 'cause there's always some kid whinning for his/her turn behind me. The next day I go out and buy the album. In fact I buy about 6 CD's, new artists each month. I enjoy the feel, taste, smell of an actual CD complete with the art work and compared to my other friends who steal 'cause they think that the internet is a free for all library and assume that artists aren't being hurt by this, I support artists as an artist myself. I'm not a musician but I make bracelets, soaps etc and I like to be paid for my art and work as does anyone else. The only thing I keep on my hard drive are rare tracks, live performances, out of print albums that I can't and will never find on e-bay, rare remixes by fans etc.

I like BD and would pay for it if I could walk into my record store and buy it and if it does come out, I will do that. Nikki from the VR forum copied the CD for me. In turn I copied it for another DM fan etc. No one is selling these boots, I'm not making a profit but people do want to hear the music. These songs aren't being played live so this is the only way for now.

Now that this official site is up and running I am hoping, for the sake of everyone that there will be pay to download tracks, like Vast did on their site, for BD. I know that there are some legal mumbo jumbo that some of us are unclear about but it would be nice to have some of Duff's work to download for $1 price a song like most pay sites.

Those sellers on e-bay who have been selling CD-R copies of BD, I have asked to burn me a copy out of good faith. Some have laughed in my face and in turn, I have turned them into e-bay's safeharbour and copyright material department. I did it not only 'cause I admire and respect Duff but I was sticking up for all artists independent or commercial who work hard for their craft.

I agree with Isabelle Guns on this score.  The only way to support artist is to buy. I spend about £60 a month on CD's.   But download hard to get hold of stuff (whoever thought up deleting stuff should be shot).

The day that BD is released I will be buying at least 3 copies.  So if I could pay for it I would, I was lucky to get this and it is a crying shame that it is just lying somewhere in Duff's house gathering dust.  Sooner or later this will be officially released.  Until then if it is shared in a non profit manner,(people that sell stuff like this should also be shot) like I did for Isabell Guns then so be it.  Perhaps record company lard arses will now get their act together and see that there is a demand for this and satisfy us all once and for all.

I agree!!!  I spend an horrendous amount on cd's cos I love music and feel you should support the artists.  I feel sad that this cd is not out for the public to enjoy, especially since it contains my very favourite Duff song - Who's To Blame.

That was another reason I put it up for download.  There was almost always at least one CD-R version up on ebay, some of them going for almost as much as a genuine promotional copy.
I really don't like the idea of people making money off someone elses work, esspecially when the original artist is getting nothing for it.

I can't say for sure that we were the reason but since me and Mistress started offering it as a free download those have dissapeared.
Although I'm sure its only a matter of time until people catch on and start selling it again.

This is something I had mentioned before:  Now that Duff has an "Official Site" (this one!)..."Why doesn't he sell 'Beautiful Disease' through this site"?  He owns the copyright.  It's his to do with as he wishes, right?  Provided, of course, that his previous record label doesn't have any kind of contractual hold on it.  When Duff had his LOADED website up and running, I bought his CD's from there.  So, why not here?

It appears that he owns the rights to the songs, but was under contract to release a set number of albums pursuant to his solo contract (which would mean that the distribution rights rest with the now defunct record label) and it isn't clear whether the new record label has any intentions of releasing it or giving it to Duff for release (as the distribution rights would have been transferred to the new company upon completion of the merger).

So.....I'm sure if he COULD sell BD through this site he would, therefore, the inference is at this point he is unable to proceed in that manner.
